However, the students and their parents suing UT and other schools allege in their complaint that "each of the universities were negligent in failing to maintain adequate protocols and security measures in place to guarantee the sanctity of the college admissions process, and to ensure that their own employees were not engaged in these type of bribery schemes."
A criminal case may in some jurisdictions be settled before a trial through a plea bargain. Typically, in a plea bargain, the defendant agrees to plead guilty to a lesser charge than that which was originally brought by the grand jury or prosecutor. A defendant who goes to trial risks greater penalties than would normally be imposed through a plea bargain.

It's also important to remember that your attorney understands the litigation process in a way that you don't. While you're a foreigner in the legal realm, your lawyer lives there. So, it's worth paying careful heed to your lawyer's advice. If you don't understand something, ask probing questions. However, always keep in mind that your lawyer has extensive professional training and experience in these matters.
It also names specific campus incidents in which it says the university restricted free speech, including a controversial event organized by the university group Young Conservatives of Texas called Catch an Illegal Immigrant, which got scrapped in 2013. The group had planned to have volunteers walk around campus with a label that said "illegal immigrant," and students who "caught" them would win gift cards. Backlash on campus spurred UT to issue a statement saying that if the group carried out the activity they would be "willfully ignoring the honor code."

As we interviewed experts on the subject, including former Justice Department officials who keep track of these things, we realized that these numbers were extraordinary. No one had an exact count comparing, say, the Obama administration’s record in court after two years with the Trump administration. But as we researched the subject, we found studies estimating the average “win rate” for administrations in the courts was somewhere around 70% whereas the Trump administration appeared to be losing at least 70% of the time.
Instead of filing an answer within the time specified in the summons, the defendant can choose to dispute the validity of the complaint by filing a demurrer (in the handful of jurisdictions where that is still allowed) or one or more "pre-answer motions," such as a motion to dismiss. It is important that the motion be filed within the time period specified in the summons for an answer. If all of the above motions are denied by the trial court, and the defendant loses on all appeals from such denials (if that option is available), and finally the defendant must file an answer.
If, upon review of your case information, the attorney determines that you have a very strong case and that State’s case may be weak, one option is to fight the case by going to trial. The decision to go to trial is always the client’s decision. Depending on the charge and the jurisdiction, this may mean a bench trial, meaning a single judge presides and makes a decision as to your guilt or innocence, or a jury trial, meaning a jury of usually 12 people decides guilt or innocence. A trial usually takes quite a bit of time to be scheduled – in North Carolina a felony trial may take as long as a year or more schedule and in others it may take two years or even more. This is based on the severity of the crime you’ve been charged with and how busy the court calendar is.

During document production, you or the other side can request any documents that might have anything to do with the case.[9] These documents may have information you can use to help you win the case. If you discover a "smoking gun" – a document that proves the person or company you're suing is liable for your damages – you can point it out and demand the other side settle. You also may be able to file a motion for summary judgment, arguing that certain facts or issues have been settled based on that piece of evidence.[10]
It is now official: Conservative Judge Brian Hagedorn has defeated liberal Judge Lisa Neubauer (pictured) in Wisconsin’s Supreme Court election. Neubauer conceded on Wednesday in a very close race, where Hagedorn won by 6,000 votes despite being the underdog. This result is a significant reversal from 2018 when the conservative Judge Michael Screnock lost by 12% to the liberal (now Justice) Rebecca Dallet. More importantly, this election was a flip from blue to red. The state Supreme Court result not only has significant consequences for policy in Wisconsin, but it is an important signifier heading into 2020.
American terminology is slightly different, in that the term "claim" refers only to a particular count or cause of action in a lawsuit. Americans also use "claim" to describe a demand filed with an insurer or administrative agency. If the claim is denied, then the claimant, policyholder, or applicant files a lawsuit with the courts to seek review of that decision and participates in the lawsuit as a plaintiff. In other words, the terms "claimant" and "plaintiff" carry substantially different connotations of formality in American English, in that only the latter risks an award of costs in favor of an adversary in a lawsuit.

A court may not render a judgment which transcends the limits of its authority, and a judgment is void if it is beyond the powers granted to the court by the law of its organization, even where the court has jurisdiction over the parties and the subject matter. The Las Vegas Municipal Court offers the Habitual Offender Prevention & Education (HOPE) Court. It is an alternative approach to sentencing that offers repeat offenders structured programs to try to help them rebuild their lives. The court has been featured in the local media because of its success. The target goal of HOPE Court is to decrease instances of criminal activity committed by an increasing large group of offenders who repeatedly consume large dollar amounts of city resources because they repeatedly end up back on the streets—loitering; being picked up again and again by police officers; back in city jail; back in court; and back in front of the judge. HOPE Court clients are indigent; they are not able to self-pay.
Another key aspect was that Judge Neubauer tried to position herself as a moderate and independent judge, despite being very connected to the Democratic Party and Planned Parenthood. When voters were informed of her connections to socialist policies and infanticide-supporting groups, it helped Hagedorn. Our organization, American Majority Action, saw this as we went door to door and spoke to voters in real time. We focused on voters in seven counties across the state. Our survey results showed a 10+% shift to Hagedorn over the final two weeks as more voters were informed of Neubauer’s radical ties. In places where we knocked on doors, we saw votes shift by 15% or more from their 2018 totals. In Oostburg, where we spoke with  hundreds of voters, we saw Hagedorn receive 361 more votes than Screnock in 2018. This happened in communities all across the state. Face-to-face communication is the best way to win over voters in any election, and given the unfair attacks by liberals in this case, it proved particularly effective.

The lawsuit from Quinault Nation, which owns and operates Quinault Beach Resort & Casino in Ocean Shores, Wash., alleges that Valve has facilitated the use of textured digital weapons, known as “skins,” in games such as Counter Strike: Global Offensive as collateral in online betting through third-party sites. The lawsuit argues that through so-called “skins gambling” Valve has “subjected Washington citizens to scam, unsafe and unfair gambling.”
In most cases, the EEOC can file a lawsuit to enforce the law only after it investigates and makes a finding that there is reasonable cause to believe that discrimination has occurred, and is unable to resolve the matter through a process called "conciliation." The EEOC has discretion which charges to litigate if conciliation efforts are unsuccessful, and ultimately litigates a small percentage of all charges filed. When deciding whether to file a lawsuit, the EEOC considers factors such as the strength of the evidence, the issues in the case, and the wider impact the lawsuit could have on the EEOC's efforts to combat workplace discrimination. The appeal is a review for errors rather than a new trial, so the appellate court will defer to the discretion of the original trial court if an error is not clear. The initial step in making an appeal consists of the petitioner filing a notice of appeal and then sending in a brief, a written document stating reason for appeal, to the court. Decisions of the court can be made immediately after just reading the written brief, or there can also be oral arguments made by both parties involved in the appeal. The appellate court then makes the decision about what errors were made when the law was looked at more closely in the lower court. There were no errors made, the case would then end, but if the decision was reversed, the appellate court would then send the case back down to the lower court level. There, a new trial will be held and new information taken into account.
