Participants may receive targeted case management, medication stabilization, mental health counseling, substance abuse counseling and residential placement. Defendants are excluded from the program if they are sex or arson offenders, drug traffickers, active gang members or have a criminal record involving weapons. If you find yourself up against a lawyer who won't stop rattling off legal citations or won't let you get a word in edgewise, you'll have to stand up for yourself. Tell the judge that you are representing yourself without a lawyer because you can't afford or justify the expense, and that you'll rely on the judge to apply the correct law and reach the right conclusions. Many judges will make an effort to keep the proceedings comprehensible to a self-represented party -- and will take steps to rein in an opposing lawyer who tries to take unfair advantage.
I’m not sure we did capture all the possible cases. The highly publicized cases, like DACA and the travel ban, are obvious. Nobody seems to keep some sort of master list of everything else. So Deanna and I began to track them down using a variety of sources. We wound up with the number 63, which even since we wrote the piece has increased to about 68.
A civil case, more commonly known as a lawsuit or controversy, begins when a plaintiff files a document called a complaint with a court, informing the court of the wrong that the plaintiff has allegedly suffered because of the defendant, and requesting a remedy. The remedy sought may be money, an injunction, which requires the defendant to perform or refrain from performing some action, or a declaratory judgment, which determines that the plaintiff has certain legal rights. The remedy will be prescribed by the court if the plaintiff wins the case. A civil case can also be arbitrated through arbitration, which may result in a faster settlement, with lower costs, than could be obtained by going through a trial.
The state caused my mother to die three months after they took her from her home and placed her in a nursing home, where she refused to eat and developed a giant bed sore. I have the evidence. I had the funeral home take pictures of her body. She weighed only 85-90 pounds all her life. When she died in the nursing home, she barely weighed 60 pounds. Before they took her from her home, the only physical problem she had was slight dementia. The trauma caused her to stop eating.

The HOPE Court judge recognizes that high-risk offenders, who may also have co-occurring disorders, or who have failed in drug abuse treatment, fare better in HOPE Court when they are required to attend frequent status checks. Under Judge Bert Brown’s close courtroom supervision, offenders move from the streets to sober living. The program's success is based upon Judge Brown’s zero judicial tolerance, coupled with rehabilitation programs and alternative sentencing.
In trying a case, a defense attorney will work to highlight the favorable facts of your case and to show the State has not proved the case beyond a reasonable doubt. He will do this in the process of examining the defense witnesses and cross-examining the State’s witnesses. The case will be summarized and important points highlighted in opening and closing arguments. Your attorney will also object to various components of the State’s case based on trial procedures and the rule of law.
Unless you are going to Small Claims Court without an attorney, if you are taking this case to court to save money or get a big payoff, it won't happen. A good example is taking a non-compete agreement case to court. After many months, perhaps years, of litigation on whether the non-compete is reasonable and whether the other party breached your non-compete agreement, the only people who win are the attorneys.
The climate response team is made up of senior university administrators who take complaints from students via an online portal that include everything from derogatory comments made on Facebook to student organizations participating in traditions that could be perceived as insensitive. Since September 2017, it has investigated more than 100 reports of "expressions of bias" in posters, fliers, social media, whiteboards and verbal comments, among others, according to the nonprofit's data. The lawsuit says these investigations can result in formal discipline for incidents that include "wide swaths of protected expression."
The Diocese of Austin was made aware this afternoon that a lawsuit was filed today in which unnamed plaintiffs make allegations against Rev. Isidore Ndagizimana, Bishop Joe S. Vásquez and the Diocese of Austin. The Diocese of Austin is currently reviewing a copy of the lawsuit. Bishop Vásquez is currently attending a meeting of the U.S. Conference of Catholic Bishops in Washington, D.C. and has not had an opportunity to review the lawsuit. However, upon being notified of the lawsuit’s filing, Bishop Vásquez authorized the extension of an invitation to meet with the unnamed plaintiffs. He also extends his prayers for the unnamed plaintiffs.
Because the vast majority of cases will settle before trial, success often means obtaining a desirable settlement. In negotiating with the other side, try to be flexible in deciding what you can live with. Your concept of a fair deal will be vastly different from the opposing party's numerical figure. While you'll want to drive a hard bargain, both sides are probably going to compromise eventually. Usually, the earlier this happens the better.

You'll eliminate some fear of the unknown, you'll start to see that attorneys go through a similar set of procedures that you are just as capable of performing yourself, and you'll get a feel for how to talk to the judge and those who might be in the same room as you.

The Las Vegas Municipal Court offers the Habitual Offender Prevention & Education (HOPE) Court. It is an alternative approach to sentencing that offers repeat offenders structured programs to try to help them rebuild their lives. The court has been featured in the local media because of its success. The target goal of HOPE Court is to decrease instances of criminal activity committed by an increasing large group of offenders who repeatedly consume large dollar amounts of city resources because they repeatedly end up back on the streets—loitering; being picked up again and again by police officers; back in city jail; back in court; and back in front of the judge. HOPE Court clients are indigent; they are not able to self-pay.
During discovery, both parties also may issue subpoenas to third-party witnesses if other individuals who are not part of the litigation nevertheless have information that may be necessary to the case.[12] For example, if you are suing someone for harassing you, you may need phone records to show how many times a day the person called you. To get those phone records, you would issue a subpoena to the phone company.

Habeas Corpus submitted for Son over a year ago, through NLA.....After serving almost three years for a "victimless Crime", with Habeas Corpus being ignored. Son will be released on 12/14/16....My question is ........He has about $6,000.00 in fines and his Driver's License from a different State is being held for blackmail until bogus fines are paid.....HOW CAN HE GET RESTITUTION OR FREEDOM FROM PAYING THESE FINES?

At the close of discovery, the parties may either pick a jury and then have a trial by jury or the case may proceed as a bench trial. A bench trial is only heard by the judge if the parties waive a jury trial or if the right to a jury trial is not guaranteed for their particular claim (such as those under equity in the U.S.) or for any lawsuits within their jurisdiction.
