A little respect goes a long way in the courtroom, particularly when you are representing yourself. Address the judge as "your honor," not as "Judge Smith" or "Mr. Smith." Try your best to be polite to your opponent, not demeaning or petty. Showing respect for people and procedures in the courtroom will help you gain the respect of the judge, which will make your day in court a more pleasant experience.
The state caused my mother to die three months after they took her from her home and placed her in a nursing home, where she refused to eat and developed a giant bed sore. I have the evidence. I had the funeral home take pictures of her body. She weighed only 85-90 pounds all her life. When she died in the nursing home, she barely weighed 60 pounds. Before they took her from her home, the only physical problem she had was slight dementia. The trauma caused her to stop eating.

Your theory must also be based on the law. For example, if you are accused of deliberately crashing into someone’s car, your theory of the case may be that the victim was negligent when she backed into the road. Unfortunately, the plaintiff’s negligence will not relieve you of liability if you deliberately hit her. Therefore, your “theory of the case” could instead be that you didn’t deliberately hit her but only negligently did, or that she deliberately backed into you.
Fourteen defendants, including parents and one coach, have pleaded guilty in the college cheating scandal. Actress Felicity Huffman is among those to plead guilty in what prosecutors call the largest college admissions scam uncovered in U.S. history. They are among 50 people who allegedly schemed to cheat college exams and pay $25 million in bribes to buy the children of affluent Americans seats in well-known universities including Yale and Georgetown. CNBC's Robert Frank reports.

1. A court may not render a judgment which transcends the limits of its authority, and a judgment is void if it is beyond the powers granted to the court by the law of its organization, even where the court has jurisdiction over the parties and the subject matter. Thus, if a court is authorized by statute to entertain jurisdiction in a particular case only, and undertakes to exercise the jurisdiction conferred in a case to which the statute has no application, the judgment rendered is void.
A civil case, more commonly known as a lawsuit or controversy, begins when a plaintiff files a document called a complaint with a court, informing the court of the wrong that the plaintiff has allegedly suffered because of the defendant, and requesting a remedy. The remedy sought may be money, an injunction, which requires the defendant to perform or refrain from performing some action, or a declaratory judgment, which determines that the plaintiff has certain legal rights. The remedy will be prescribed by the court if the plaintiff wins the case. A civil case can also be arbitrated through arbitration, which may result in a faster settlement, with lower costs, than could be obtained by going through a trial.

AALL and chapter volunteers researched primary legal materials in the 50 states plus District of Columbia to determine if online legal materials are trustworthy and preserved for permanent public access. This collection brings together information from AALL's National Inventory of Legal Materials and updates, the Preliminary Analysis of AALL’s State Legal Inventories, the 2007 State-by-State Report on Authentication of Online Legal Resources and the 2009-2010 State Summary Updates.
The best cases are the ones that aren’t cases yet. This means that charges have not yet been pressed. If you know that you have committed a crime or you have been contacted by law enforcement investigating a crime, you are in a good position because it means evidence is still being gathered and a warrant has not yet been issued. This is usually the best and most important time to hire a criminal defense attorney.
“Like many students and families across the country, we are also outraged that parents, outside actors and university employees may have committed fraud surrounding admissions at universities," UT spokesman J.B. Bird said. "The actions alleged by federal prosecutors against one UT employee were not in line with that policy and may have been criminal. They do not reflect our admissions process."

Definitely don't make your litigation decisions for vindictive reasons. You'll only end up hurting yourself. Besides generating excessive litigation expenses, your health and happiness will suffer. If you look honestly in the mirror and realize that your motivation is spite or revenge, it's in your own best interests to find a way to settle or otherwise end the case.

At trial, each person presents witnesses and the evidence collected is recorded. After this occurs, the judge or jury renders their decision. Generally speaking, the plaintiff has the burden of proof in making his claims, however, the defendant may have the burden of proof on other issues, such as affirmative defenses. The attorneys are held responsible in devising a trial strategy that ensures they meet the necessary elements of their case or (when the opposing party has the burden of proof) to ensure the opponent will not be able to meet his or her burden.
