8. "Courts are constituted by authority and they cannot go beyond that power delegated to them. If they act beyond that authority, and certainly in contravention of it, their judgements and orders are regarded as nullities ; they are not voidable, but simply void, and this even prior to reversal." The appeal is a review for errors rather than a new trial, so the appellate court will defer to the discretion of the original trial court if an error is not clear. The initial step in making an appeal consists of the petitioner filing a notice of appeal and then sending in a brief, a written document stating reason for appeal, to the court. Decisions of the court can be made immediately after just reading the written brief, or there can also be oral arguments made by both parties involved in the appeal. The appellate court then makes the decision about what errors were made when the law was looked at more closely in the lower court. There were no errors made, the case would then end, but if the decision was reversed, the appellate court would then send the case back down to the lower court level. There, a new trial will be held and new information taken into account.

You won't win a lawsuit by simply striding into the courthouse and demanding money from your opponent. Each type oflegal claimhas a number of "elements" that you'll need to prove in order to win. For example, in a dispute over a contract, you must prove that a contract existed, that you held up your end of the bargain, that your opponent failed to meet his or her contractual obligations, and that you were harmed as a result. You'll want to plan ahead carefully to make sure that you can prove every element of your case -- or, if you are defending yourself against a lawsuit, to make sure that you can disprove at least one element of your opponent's case.

“Like many students and families across the country, we are also outraged that parents, outside actors and university employees may have committed fraud surrounding admissions at universities," UT spokesman J.B. Bird said. "The actions alleged by federal prosecutors against one UT employee were not in line with that policy and may have been criminal. They do not reflect our admissions process."

With mediation, you and the other party meet with a neutral third party, who facilitates discussion. The third-party neutral does not decide the case; however, he or she will help the parties find common ground. The mediator may also propose potential ways to resolve the dispute.[16] Mediation can be a cost-effective way of resolving a dispute to your (and the other party’s) satisfaction.
I have been reading Fight your Ticket about California laws for years and don't know what I would do without it. It has helped me win in court and know just what to ask the cop giving the ticket. It helps research and I recommend these books. Now my grand niece is getting her license and does not live in CA so I picked this up for her. I hope she reads it, it really helps get a handle on interactions with the police when you get stopped.
Your theory must also be based on the law. For example, if you are accused of deliberately crashing into someone’s car, your theory of the case may be that the victim was negligent when she backed into the road. Unfortunately, the plaintiff’s negligence will not relieve you of liability if you deliberately hit her. Therefore, your “theory of the case” could instead be that you didn’t deliberately hit her but only negligently did, or that she deliberately backed into you.
Definitely don't make your litigation decisions for vindictive reasons. You'll only end up hurting yourself. Besides generating excessive litigation expenses, your health and happiness will suffer. If you look honestly in the mirror and realize that your motivation is spite or revenge, it's in your own best interests to find a way to settle or otherwise end the case.

Fourteen defendants, including parents and one coach, have pleaded guilty in the college cheating scandal. Actress Felicity Huffman is among those to plead guilty in what prosecutors call the largest college admissions scam uncovered in U.S. history. They are among 50 people who allegedly schemed to cheat college exams and pay $25 million in bribes to buy the children of affluent Americans seats in well-known universities including Yale and Georgetown.
