Identify evidence and witnesses. The parties in a lawsuit have the right to request copies of documents in each other’s possession or control in a process called “discovery.” In discovery, you can also request that the other party answer questions, either orally or in writing. If you request a document and the other side claims not to have it, research whether or not they have destroyed it.

“He did however find the time to produce a video and a 40-page mailer distributed to constituents attacking The Fresno Bee and its coverage of the Alpha Omega winery case. Logically, California is a more appropriate location to try this case since Mr. Nunes represents a constituency in California, McClatchy is based in California – for 162 years – and The Fresno Bee is the Representative’s hometown newsroom.
I'd been planning to spend a few days in a nearby city, so I hired a nurse to look after my mother while I was away. Two hours after I left, while I was still on the airplane, APS came to my mother's place and found her alone. The nurse I hired foolishly stepped out for some reason, and when she returned APS was there. They took my mother to a nursing home against her will.
Certain types of cases can only be heard by judges. In many cases, however, either party hasthe right to request that the case be heard by a jury. Most people representing themselves will do better in front of a judge than a jury -- jury trials are more complicated for a variety of reasons, and presenting your case to a judge will make your job quite a bit easier. However, if your opponent requests a jury trial, you will have to deal with a jury, whether you want one or not.
During discovery, both parties also may issue subpoenas to third-party witnesses if other individuals who are not part of the litigation nevertheless have information that may be necessary to the case.[12] For example, if you are suing someone for harassing you, you may need phone records to show how many times a day the person called you. To get those phone records, you would issue a subpoena to the phone company.
Tulane University student Lauren Fidelak said she applied to USC and UCLA and was turned down, then had an emotional breakdown and had to be hospitalized, the suit says. Her mother, Keri Fidelak, and Johnson's father, James, have also joined the suit, along with Stanford student Kalea Woods and California community college student Tyler Bendis, and his mother, Julia.

Tell the story behind the litigation: At the heart of litigation efforts are stories of injustice to real people.  Our campaigns have sought to use the emotional resonance of the injustice of real stories as crucial ways to make our case and grow support.  Edie Windsor in the DOMA case was a compelling figure – and with a smart media strategy behind her, her story became a face of the injustice of DOMA and the need to dismantle it once and for all.   While the media loves covering the ins and outs of the court process and politics, what moves hearts and minds are people’s actual stories. It’s certainly wise to elevate the story that’s being discussed in the litigation.  It’s also wise to identify and amplify similar stories of injustice in the state and across the country similar to the story being considered in court.
The LII Supreme Court Bulletin is LII's free Supreme Court email-based subscriber and web-based publication service.[17] The Bulletin provides subscribers with two distinct services.[18] The first is a notification service. LII Bulletin emails subscribers with timely notification of when the US Supreme Court has handed down a decision.[19] It also provides subscribers links to the full opinions of those cases on the LII site.[19]
It would have taken six or seven months to get exact numbers. But every expert we talked to agreed that the volume was much higher for the Trump administration. The question then became why. As I wrote in an earlier story, when the losing streak started, it’s kind of like relationships. When one or two don’t work out, you can plausibly blame the other people. When the numbers mount, you have to think, maybe the problem is me, that is, maybe I’m doing something wrong.
Once you know the elements you'll have to prove to win your case, you can figure out what types of evidence will help you prove each key fact. However, not every kind of evidence can be presented in a courtroom: Complicated rules of evidence determine whether a particular document, statement, or item is admissible in court. Although you don't have to master every detail of these rules, you should do enough research to make sure that you'll be able to present the evidence you need to win.

Cornell’s Legal Information Institute is celebrating Constitution Day by publishing the first publicly-available web version of the Congressional Research Service’s Constitution Annotated, a non-partisan publication that helps readers appreciate how Americans’ collective understanding of our governing principles has changed throughout our history on timely issues such as the scope of presidential power, limits on free speech, or the right to bear arms.  Read More Here

Pretty good book but in the real world it may not help you much. I decided to fight a ticket and the cop lied on the stand and I wasn't really prepared for that and the jurors were all dumb as a box of rocks and I could only choose 5 out of 30 to reject in Voir Dire. So the book has good ideas but the U.S. legal system is so jacked up that if you are a little guy you are going to have to bend over one way or another. Can't wait for the revolution, this system has to go.

The Las Vegas Municipal Court offers the Habitual Offender Prevention & Education (HOPE) Court. It is an alternative approach to sentencing that offers repeat offenders structured programs to try to help them rebuild their lives. The court has been featured in the local media because of its success. The target goal of HOPE Court is to decrease instances of criminal activity committed by an increasing large group of offenders who repeatedly consume large dollar amounts of city resources because they repeatedly end up back on the streets—loitering; being picked up again and again by police officers; back in city jail; back in court; and back in front of the judge. HOPE Court clients are indigent; they are not able to self-pay.

I have represented myself in various state and federal courts for years and have experienced firsthand just how unfair our system of justice can be against a person who decides to represent himself. Not long ago a federal judge looked me in the eye and told me just before the trial that I wouldn’t win. The judge did a lot of things during the trial to make it unfair for me, but I did win.
Your theory must also be based on the law. For example, if you are accused of deliberately crashing into someone’s car, your theory of the case may be that the victim was negligent when she backed into the road. Unfortunately, the plaintiff’s negligence will not relieve you of liability if you deliberately hit her. Therefore, your “theory of the case” could instead be that you didn’t deliberately hit her but only negligently did, or that she deliberately backed into you.
I have been reading Fight your Ticket about California laws for years and don't know what I would do without it. It has helped me win in court and know just what to ask the cop giving the ticket. It helps research and I recommend these books. Now my grand niece is getting her license and does not live in CA so I picked this up for her. I hope she reads it, it really helps get a handle on interactions with the police when you get stopped.
I finally decided to invest in the program and start to learn "How to Win in Court"! Your program saved me. Learning the rules of court make a difference! The HOA dropped the case. Thank you for everything! I now can start my life over after 10 years of unfounded harassment from greedy people who don't care! The only regret is I did not order your program sooner. ... Becca C.

But these attacks backfired and motivated the conservative base. They saw that the attacks on Hagedorn’s school were in effect imposing an unconstitutional religious test: that you cannot be a Christian and a judge. These groups were functionally persecuting Hegedorn for his religious beliefs. And whether voters held those same beliefs or not, they didn’t fall for the bigoted attacks. When voters heard about this, they were upset and motivated to take action. The conservative grassroots went out and knocked on doors, texted friends and family members, and delivered more votes for Hagedorn.
Some jurisdictions, notably the United States, but prevalent in many other countries, prevent parties from relitigating the facts on appeal, due to a history of unscrupulous lawyers deliberately reserving such issues in order to ambush each other in the appellate courts (the "invited error" problem). The idea is that it is more efficient to force all parties to fully litigate all relevant issues of fact before the trial court. Thus, a party who does not raise an issue of fact at the trial court level generally cannot raise it on appeal.
