Certain types of cases can only be heard by judges. In many cases, however,either party hasthe right to request that the case be heard by a jury. Most people representing themselves will do better in front of a judge than a jury -- jury trials are more complicated for a variety of reasons, and presenting your case to a judge will make your job quite a bit easier. However, if your opponent requests a jury trial, you will have to deal with a jury, whether you want one or not.

Much of the 25-page court document lays out Valve’s alleged involvement in skins gambling, but the lawsuit also claims skins gambling hurts casinos. In order to operate, Quinault’s casino has to take steps to ensure fair and secure gambling conditions and pay taxes and fees to state and local governments. Valve, the lawsuit argues, doesn’t have to do any of that, creating an alleged unlevel playing field.
There was a study conducted in the Supreme Court Economic Review that shows why litigation financing can be practical and beneficial to the overall court system and lawsuits within the court. This study concluded that the new rules that were set for litigation financing actually did produce more settlements. Under conservative rules, there tended to be fewer settlements, however under the older rules they tended to be larger on average.[11]

I'd also like to mention for those of you who are looking for Child Support help, this is not a good book for that. It has a tiny section on Child Support, then leaves you hanging. This may be because laws vary so much, but I thought I'd at least point it out. The book is more for general concepts, so the info falls short once you begin specializing in certain subject matters.

Whether you have been sued, or are planning to sue, you can win your case at various stages of the litigation. You must understand the law as well as the applicable procedural rules. You will win a case if you can show that your opponent missed a filing deadline, has no legitimate cause of action, spoiled or destroyed evidence, or doesn’t have strong enough evidence to win at trial.
The decisions that the jury makes are not put into effect until the judge makes a judgment, which is the approval to have this trial information be filed in public records. In a civil case, the judge is allowed at this time to make changes to the verdict that the jury came up with by either adding on or reducing the punishment. In criminal cases the situation is a little different, because in this case the judge does not have the authority to change the jury decision.
With mediation, you and the other party meet with a neutral third party, who facilitates discussion. The third-party neutral does not decide the case; however, he or she will help the parties find common ground. The mediator may also propose potential ways to resolve the dispute.[16] Mediation can be a cost-effective way of resolving a dispute to your (and the other party’s) satisfaction.

In 2015, an investigation commissioned by the UT System concluded that then-President Bill Powers sometimes ordered that students touted by regents, legislators, donors and other prominent people be admitted despite objections from the admissions office. The Las Vegas Municipal Court offers the Habitual Offender Prevention & Education (HOPE) Court. It is an alternative approach to sentencing that offers repeat offenders structured programs to try to help them rebuild their lives. The court has been featured in the local media because of its success. The target goal of HOPE Court is to decrease instances of criminal activity committed by an increasing large group of offenders who repeatedly consume large dollar amounts of city resources because they repeatedly end up back on the streets—loitering; being picked up again and again by police officers; back in city jail; back in court; and back in front of the judge. HOPE Court clients are indigent; they are not able to self-pay.

Many people presume that judges issue rulings in court based simply on the facts at hand, without public opinion playing any role at all.  However, history tells us that how judges read laws and constitutions very much reflects where public opinion is (or, at least, what they think the public will accept).   Leading up to the final Supreme Court marriage victory, Justice Ruth Bader Ginsburg said in an interview that “there hasn’t been any major change…in which there wasn’t a groundswell among the people before the Supreme Court put its stamp of approval on the inclusion in the equality concept of people who were once left out.” 
I have represented myself in various state and federal courts for years and have experienced firsthand just how unfair our system of justice can be against a person who decides to represent himself. Not long ago a federal judge looked me in the eye and told me just before the trial that I wouldn’t win. The judge did a lot of things during the trial to make it unfair for me, but I did win.

I have been reading Fight your Ticket about California laws for years and don't know what I would do without it. It has helped me win in court and know just what to ask the cop giving the ticket. It helps research and I recommend these books. Now my grand niece is getting her license and does not live in CA so I picked this up for her. I hope she reads it, it really helps get a handle on interactions with the police when you get stopped.
The lawsuit from Quinault Nation, which owns and operates Quinault Beach Resort & Casino in Ocean Shores, Wash., alleges that Valve has facilitated the use of textured digital weapons, known as “skins,” in games such as Counter Strike: Global Offensive as collateral in online betting through third-party sites. The lawsuit argues that through so-called “skins gambling” Valve has “subjected Washington citizens to scam, unsafe and unfair gambling.”

A court may not render a judgment which transcends the limits of its authority, and a judgment is void if it is beyond the powers granted to the court by the law of its organization, even where the court has jurisdiction over the parties and the subject matter. Thus, if a court is authorized by statute to entertain jurisdiction in a particular case only, and undertakes to exercise the jurisdiction conferred in a case to which the statute has no application, the judgment rendered is void.
The best cases are the ones that aren’t cases yet. This means that charges have not yet been pressed. If you know that you have committed a crime or you have been contacted by law enforcement investigating a crime, you are in a good position because it means evidence is still being gathered and a warrant has not yet been issued. The focus for this specialty drug court is on those defendants between the ages of 18 and 24, young offenders (YO), and requires family support and participation. The program was launched in July 2010 and follows an intensive supervision drug court model with a focus on family treatment. This team has found a formula that is successful with the drug court defendants, especially with young offenders. YO Court mandates frequent court status checks, substance abuse treatment, community service activities, random drug testing, life skill classes, homework assignments and family involvement.

I watch the federal courts closely and became aware over time that the administration was being challenged in court on almost every important policy and deregulatory decision and that U.S. district court judges, who ordinarily defer to the government in most of these challenges, were no longer doing so. Deanna Paul and I began keeping track of the adverse rulings. I’ve been watching regulation and courts for a very long time, and the numbers of defeats were well beyond anything I had seen.
