I watch the federal courts closely and became aware over time that the administration was being challenged in court on almost every important policy and deregulatory decision and that U.S. district court judges, who ordinarily defer to the government in most of these challenges, were no longer doing so. Deanna Paul and I began keeping track of the adverse rulings. I’ve been watching regulation and courts for a very long time, and the numbers of defeats were well beyond anything I had seen.
There are numerous motions that either party can file throughout the lawsuit to terminate it "prematurely"—before submission to the judge or jury for final consideration. These motions attempt to persuade the judge, through legal argument and sometimes accompanying evidence, that there is no reasonable way that the other party could legally win and therefore there is no sense in continuing with the trial. Motions for summary judgment, for example, can usually be brought before, after, or during the actual presentation of the case. Motions can also be brought after the close of a trial to undo a jury verdict contrary to law or against the weight of the evidence, or to convince the judge to change the decision or grant a new trial.
The Telephone Counseling Line provides education and information regarding residential tenant-landlord disputes. Lines are busy, and callers are encouraged to keep trying. Phones are answered by trained housing counselors who offer options, refer callers to other agencies, or suggest legal assistance through Legal Aid, lawyer referral services, etc. The counselors can discuss tenant-landlord rights and responsibilities as described in the Texas Property Code and other sources. The LII Supreme Court Bulletin is LII's free Supreme Court email-based subscriber and web-based publication service. The Bulletin provides subscribers with two distinct services. The first is a notification service. LII Bulletin emails subscribers with timely notification of when the US Supreme Court has handed down a decision. It also provides subscribers links to the full opinions of those cases on the LII site.
The Legal Information Institute (LII) is a non-profit, public service of Cornell Law School that provides no-cost access to current American and international legal research sources online at law.cornell.edu. The organization is a pioneer in the delivery of legal information online. Founded in 1992 by Peter Martin and Tom Bruce, LII was the first law site developed on the internet. LII electronically publishes on the Web the U.S. Code, U.S. Supreme Court opinions, Uniform Commercial Code, the US Code of Federal Regulations, several Federal Rules, and a variety of other American primary law materials. LII also provides access to other national and international sources, such as treaties and United Nations materials. According to its website, the LII serves over 30 million unique visitors per year.
Instead of filing an answer within the time specified in the summons, the defendant can choose to dispute the validity of the complaint by filing a demurrer (in the handful of jurisdictions where that is still allowed) or one or more "pre-answer motions," such as a motion to dismiss. It is important that the motion be filed within the time period specified in the summons for an answer. If all of the above motions are denied by the trial court, and the defendant loses on all appeals from such denials (if that option is available), and finally the defendant must file an answer.
