Try to maintain a subtle, composed smile at all times. “Practice in the mirror. You don’t want to look like a crazy person. But you might discover that a subtle, practiced smile looks friendlier and exudes more confidence than your natural expression does at rest. There’s truth to that 1980s deodorant slogan, ‘Never let them see you sweat.’ Your star witness buckles under cross-examination? Smile your subtle, practiced smile. Unexpected testimony shocks you? Subtle smile. If you frown or rock backward in surprise, a juror might conclude that you think your case has been undermined. If you keep your neutral, subtle smile, it instead says: ‘Everything’s going my way, just as I expected, all part of my master plan.’”
Once you file the necessary papers to begin a lawsuit, you will face a number of deadlines -- for everything from requestingthat your case be heard by a juryto telling your opponent what evidence you plan to introduce at trial. Make careful note of these deadlines and make sure that you meet every one. The judge won't give you any leeway just because you are representing yourself -- and missing an important deadline could result in your case being thrown out of court.

In most systems, the governing body responsible for overseeing the courts assigns a unique number/letter combination or similar designation to each case in order to track the various disputes that are or have been before it. The outcome of the case is recorded, and can later be reviewed by obtaining a copy of the documents associated with the designation previously assigned to the case.
Nathan had been asked by the SEC to hold Musk in contempt over a Feb. 19 tweet where the regulator said he improperly posted material information about Tesla's vehicle production outlook without first seeking approval from company lawyers. The SEC said pre-approval had been a core element of the October 2018 settlement, which resolved a lawsuit over Musk's...

A criminal case may in some jurisdictions be settled before a trial through a plea bargain. Typically, in a plea bargain, the defendant agrees to plead guilty to a lesser charge than that which was originally brought by the grand jury or prosecutor. A defendant who goes to trial risks greater penalties than would normally be imposed through a plea bargain.
Tell the story behind the litigation: At the heart of litigation efforts are stories of injustice to real people.  Our campaigns have sought to use the emotional resonance of the injustice of real stories as crucial ways to make our case and grow support.  Edie Windsor in the DOMA case was a compelling figure – and with a smart media strategy behind her, her story became a face of the injustice of DOMA and the need to dismantle it once and for all.   While the media loves covering the ins and outs of the court process and politics, what moves hearts and minds are people’s actual stories. It’s certainly wise to elevate the story that’s being discussed in the litigation.  It’s also wise to identify and amplify similar stories of injustice in the state and across the country similar to the story being considered in court.

I took the time to watch a recent course produced by Courtroom5 and the great information it gave, and I couldn’t help thinking how I definitely would have turned to Courtroom5 to help with my case had I known about it while my case was going on. Courtroom5 offers a magnificent service that can be very helpful to pro se litigants. I would highly recommend to any pro se who is in need of some help in prosecuting his/her case to turn to Courtroom5.

If the facts in your case are questionable and there is significant risk for conviction at trial and the potential consequences are too high, an alternative to resolving your case by trial is to accept a plea agreement. It is important to have a criminal lawyer, whether hired or court appointed, helping you with your case, but this is especially true if you are considering a plea.

Use of the Documents for any other purpose is expressly prohibited. Such action is prohibited by law. Everybody who breaks the License Agreement risks the civil and criminal penalties and fort litigation, in which ESET will demand adequate compensation and reparation for its legal rights violation. ESET is not responsible for the content or accuracy of Documents that have been modified subsequent to ESET’s written consent.

Some jurisdictions, notably the United States, but prevalent in many other countries, prevent parties from relitigating the facts on appeal, due to a history of unscrupulous lawyers deliberately reserving such issues in order to ambush each other in the appellate courts (the "invited error" problem). The idea is that it is more efficient to force all parties to fully litigate all relevant issues of fact before the trial court. Thus, a party who does not raise an issue of fact at the trial court level generally cannot raise it on appeal.
In 2015, an investigation commissioned by the UT System concluded that then-President Bill Powers sometimes ordered that students touted by regents, legislators, donors and other prominent people be admitted despite objections from the admissions office. Powers said he always acted in the university's best interests, and it is an open secret that presidents of public and private universities sometimes put a thumb on the admissions scale.
Litigation was the pathway to the freedom to marry in many states. It often takes a judge to challenge prevailing assumptions (and even prejudice) that political decision-makers such as legislators or voters may be more unwilling to overcome. Early on, we won in state courts, first in Hawaii in the 1990s, then in Massachusetts, California, Connecticut, and Iowa. Later, we won in federal court, first in California, then in Utah, Oklahoma, and beyond, all the way up to the Supreme Court. In total, 25 of our final state victories (aside from the 13 final states we won at the U.S. Supreme Court) came through judicial rulings – 5 in state court and the rest in federal court.  Most of these court wins came through our movement’s legal arm – the American Civil Liberties Union, Gay & Lesbian Advocates & Defenders, Lambda Legal, and the National Center for Lesbian Rights – while a significant share were initiated by private attorneys and assisted by growing numbers of law firms eager to join in the progress. Several of these victories, though, were stripped away by political attack, and most of them would not have happened had we not built momentum in public understanding and even the politics of the marriage debate, creating the climate for the courts to rule in our favor and ensure that the public and elected officials would accept the outcome.
Identify evidence and witnesses. The parties in a lawsuit have the right to request copies of documents in each other’s possession or control in a process called “discovery.” In discovery, you can also request that the other party answer questions, either orally or in writing. If you request a document and the other side claims not to have it, research whether or not they have destroyed it.
"Ensuring that fair and transparent admissions processes exist across the UT System is necessary to maintain public trust," the university has stated in admission policy documents. "Recruitment and admissions policies that are disclosed to the public and are consistent with stated university goals garners public trust that student admissions are centered on merit."

Lethal Take of Sea Lions: One of the most frustrating things you can face when you have a salmon or steelhead on the line, is a sea lion taking your catch. We have been directly involved in a successful lawsuit against the U.S. Humane Society to support the ODFW plan to use force against these problem predators. This is both an ESA issue and a human safety issue for sport anglers.
Certain types of cases can only be heard by judges. In many cases, however, either party hasthe right to request that the case be heard by a jury. Most people representing themselves will do better in front of a judge than a jury -- jury trials are more complicated for a variety of reasons, and presenting your case to a judge will make your job quite a bit easier. However, if your opponent requests a jury trial, you will have to deal with a jury, whether you want one or not.

The state caused my mother to die three months after they took her from her home and placed her in a nursing home, where she refused to eat and developed a giant bed sore. I have the evidence. I had the funeral home take pictures of her body. She weighed only 85-90 pounds all her life. When she died in the nursing home, she barely weighed 60 pounds. Before they took her from her home, the only physical problem she had was slight dementia. The trauma caused her to stop eating.
Also, at any time during this process from the filing of the complaint to the final judgment, the plaintiff may withdraw the complaint and end the whole matter, or the defendant may agree to a settlement. If the case settles, the parties might choose to enter into a stipulated judgment with the settlement agreement attached, or the plaintiff may simply file a voluntary dismissal, so that the settlement agreement is never entered into the court record.
