I have been reading Fight your Ticket about California laws for years and don't know what I would do without it. It has helped me win in court and know just what to ask the cop giving the ticket. It helps research and I recommend these books. Now my grand niece is getting her license and does not live in CA so I picked this up for her. I hope she reads it, it really helps get a handle on interactions with the police when you get stopped.
A civil case, more commonly known as a lawsuit or controversy, begins when a plaintiff files a document called a complaint with a court, informing the court of the wrong that the plaintiff has allegedly suffered because of the defendant, and requesting a remedy. The remedy sought may be money, an injunction, which requires the defendant to perform or refrain from performing some action, or a declaratory judgment, which determines that the plaintiff has certain legal rights. The remedy will be prescribed by the court if the plaintiff wins the case. A civil case can also be arbitrated through arbitration, which may result in a faster settlement, with lower costs, than could be obtained by going through a trial.

There are numerous motions that either party can file throughout the lawsuit to terminate it "prematurely"—before submission to the judge or jury for final consideration. These motions attempt to persuade the judge, through legal argument and sometimes accompanying evidence, that there is no reasonable way that the other party could legally win and therefore there is no sense in continuing with the trial. Motions for summary judgment, for example, can usually be brought before, after, or during the actual presentation of the case. Motions can also be brought after the close of a trial to undo a jury verdict contrary to law or against the weight of the evidence, or to convince the judge to change the decision or grant a new trial.
That’s why Freedom to Marry’s strategy – while always building toward a win in the Supreme Court, and very much embracing litigation as a key methodology – was to marshal and invest energy and resources in making as strong a case in the court of public opinion as our advocates and plaintiffs were also making in the court of law. Here’s a look at key tactics we employed to creating the climate to win and hold victories in the courts.

Washington state has become a battleground over the legality of online gambling. A landmark ruling last year against the then-parent company of Seattle-based Big Fish Games found that it was facilitating online gambling because the chips in the company’s casual casino games represented a “thing of value” under state law because users can’t play without them.
The appeal is a review for errors rather than a new trial, so the appellate court will defer to the discretion of the original trial court if an error is not clear. The initial step in making an appeal consists of the petitioner filing a notice of appeal and then sending in a brief, a written document stating reason for appeal, to the court. Decisions of the court can be made immediately after just reading the written brief, or there can also be oral arguments made by both parties involved in the appeal. The appellate court then makes the decision about what errors were made when the law was looked at more closely in the lower court. There were no errors made, the case would then end, but if the decision was reversed, the appellate court would then send the case back down to the lower court level. There, a new trial will be held and new information taken into account.
Depending on the nature of the allegation, a criminal lawyer will sometimes be able to prevent criminal charges from being filed. A lawyer’s job in pre-arrest representation is to manage the flow of information, if any, between you and law enforcement. The information gathering phase is critical in an investigation and making the right decisions about what information to share and not to share could mean the difference between being charged or not being charged, and worse, being found guilty or not-guilty.
Defendants, civil rights organizations, public interest organizations, and government public officials can all set up an account to pay for litigation costs and legal expenses. These legal defense funds can have large membership counts where the members contribute to the fund. Unlike legal financing from legal financing companies, legal defense funds provide a separate account for litigation rather than a one-time cash advancement, nevertheless, both are used for purposes of financing litigation and legal costs.
American terminology is slightly different, in that the term "claim" refers only to a particular count or cause of action in a lawsuit. Americans also use "claim" to describe a demand filed with an insurer or administrative agency. If the claim is denied, then the claimant, policyholder, or applicant files a lawsuit with the courts to seek review of that decision and participates in the lawsuit as a plaintiff. In other words, the terms "claimant" and "plaintiff" carry substantially different connotations of formality in American English, in that only the latter risks an award of costs in favor of an adversary in a lawsuit.

Your theory must also be based on the law. For example, if you are accused of deliberately crashing into someone’s car, your theory of the case may be that the victim was negligent when she backed into the road. Unfortunately, the plaintiff’s negligence will not relieve you of liability if you deliberately hit her. Therefore, your “theory of the case” could instead be that you didn’t deliberately hit her but only negligently did, or that she deliberately backed into you.
In most systems, the governing body responsible for overseeing the courts assigns a unique number/letter combination or similar designation to each case in order to track the various disputes that are or have been before it. The outcome of the case is recorded, and can later be reviewed by obtaining a copy of the documents associated with the designation previously assigned to the case.
If you can afford it, find a lawyer who specializes in the area of law that is the subject of the lawsuit. Some attorneys only practice criminal defense, or they specialize in defamation or employment law. You can find an experienced attorney by visiting your state’s bar association website, which runs a referral program. You can search by area of expertise.
The Justice Department announced criminal charges against WikiLeaks co-founder Julian Assange on Thursday, accusing him of conspiring with Chelsea Manning to hack into a classified U.S. government computer. "The charge relates to Assange's alleged role in one of the largest compromises of classified information in the history of the United States," the DOJ says. Assange was arrested Thursday at the Ecuadorian Embassy in London, where he had been living for nearly seven years.

If, upon review of your case information, the attorney determines that you have a very strong case and that State’s case may be weak, one option is to fight the case by going to trial. The decision to go to trial is always the client’s decision. Depending on the charge and the jurisdiction, this may mean a bench trial, meaning a single judge presides and makes a decision as to your guilt or innocence, or a jury trial, meaning a jury of usually 12 people decides guilt or innocence. A trial usually takes quite a bit of time to be scheduled – in North Carolina a felony trial may take as long as a year or more schedule and in others it may take two years or even more. This is based on the severity of the crime you’ve been charged with and how busy the court calendar is.

The Diocese of Austin was made aware this afternoon that a lawsuit was filed today in which unnamed plaintiffs make allegations against Rev. Isidore Ndagizimana, Bishop Joe S. Vásquez and the Diocese of Austin. The Diocese of Austin is currently reviewing a copy of the lawsuit. Bishop Vásquez is currently attending a meeting of the U.S. Conference of Catholic Bishops in Washington, D.C. and has not had an opportunity to review the lawsuit. However, upon being notified of the lawsuit’s filing, Bishop Vásquez authorized the extension of an invitation to meet with the unnamed plaintiffs. He also extends his prayers for the unnamed plaintiffs.


A lawsuit begins when a complaint or petition, known as a pleading,[6] is filed with the court. A complaint should explicitly state that one or more plaintiffs seek(s) damages or equitable relief from one or more stated defendants, and also should state the relevant factual allegations supporting the legal claims brought by the plaintiff(s). As the initial pleading, a complaint is the most important step in a civil case because a complaint sets the factual and legal foundation for the entirety of a case. While complaints and other pleadings may ordinarily be amended by a motion with the court, the complaint sets the framework for the entire case and the claims that will be asserted throughout the entire lawsuit.
