Kill them with kindness. “Be nice to everyone in the courtroom. Kindness makes the world a better place, and it makes you a happier person. But if that’s not enough to convince you, consider this: Kindness makes you more likely to win your case. When jurors think you’re a good person, they’ll give you the benefit of the doubt and ascribe good motives to what you say. If they think you’re nasty or dishonest, they’ll discount everything that comes out of your mouth.

That’s why Freedom to Marry’s strategy – while always building toward a win in the Supreme Court, and very much embracing litigation as a key methodology – was to marshal and invest energy and resources in making as strong a case in the court of public opinion as our advocates and plaintiffs were also making in the court of law. Here’s a look at key tactics we employed to creating the climate to win and hold victories in the courts.
Once you file the necessary papers to begin a lawsuit, you will face a number of deadlines -- for everything from requestingthat your case be heard by a juryto telling your opponent what evidence you plan to introduce at trial. Make careful note of these deadlines and make sure that you meet every one. The judge won't give you any leeway just because you are representing yourself -- and missing an important deadline could result in your case being thrown out of court.
If you find yourself up against a lawyer who won't stop rattling off legal citations or won't let you get a word in edgewise, you'll have to stand up for yourself. Tell the judge that you are representing yourself without a lawyer because you can't afford or justify the expense, and that you'll rely on the judge to apply the correct law and reach the right conclusions. Many judges will make an effort to keep the proceedings comprehensible to a self-represented party -- and will take steps to rein in an opposing lawyer who tries to take unfair advantage.
When a final judgment is entered, the plaintiff is usually barred under the doctrine of res judicata from relitigating any of the issues, even under different legal theories. Substantial assistance is affectionately known as snitching. While it has a bad rap, it is an extremely useful tool when dealing with criminal cases. If you are not yet charged with a crime and are being investigated, providing substantial assistance can actually prevent you from being charged in some cases. If a warrant cannot be prevented with substantial assistance, charges can often be minimized and/or consequences can be reduced, often significantly.
A lawyer’s role in substantial assistance is brokering an agreement with law enforcement and/or the District Attorney to make sure you are getting the a good deal for the information you are going to provide. Unless there’s a deal in place of some sort, any information you provide may not be credited to you and you may receive no benefit, so it’s important that an attorney ensures an appropriate deal is agreed upon.
However, it is often more convenient to refer to cases – particularly landmark and other notable cases – by a title of the form Claimant v Defendant (e.g. Arkell v Pressdram). Where a legal proceeding does not have formally designated adverse parties, a form such as In re, Re or In the matter of is used (e.g. In re Gault).[1] The "v" separating the parties is an abbreviation of the Latin versus, but, when spoken in Commonwealth countries, it is normally rendered as "and" or "against" (as in, for example, Charles Dickens' Jarndyce and Jarndyce). Where it is considered necessary to protect the anonymity of a natural person, some cases may have one or both parties replaced by a standard pseudonym (Jane Roe in Roe v. Wade) or by an initial (D v D). In titles such as R v Adams, however, the initial "R" is usually an abbreviation for the Latin Rex or Regina, i.e. for the Crown. (For an explanation of other terms that may appear in case titles, see the Glossary of legal terms.)

Focus field organizing on creating media moments: Litigation-related field efforts should focus on creating media moments that demonstrate support, highlight harms, and create a climate for victory.  Freedom to Marry worked with state organizations in litigation states to organize groupings of supporters that we knew would be newsworthy—Florida First Responders for the Freedom to Marry, Texas Faith Leaders for the Freedom to Marry, etc. Another tactic that created a media moment was launching petitions urging state attorneys general to drop their defense of anti-marriage laws (we’d pursue this only after consultation with the litigation team). The petitions – which always ended with an in-person drop-off featuring children of same-sex couples, adorably wrapped petitions, and families who needed the freedom to marry – were a creative way to build online buzz for the court cases, give supporters a way to get involved with the legal case, and earn some strong media attention that underlined the overarching messages of the campaign.  We’d look to identify the most compelling personal stories that we thought might impact the public.  Additionally, we’d organize Town Hall meetings as a focus point to gather supporters and provide a platform for newsworthy supporters and people with compelling stories.   
If the facts in your case are questionable and there is significant risk for conviction at trial and the potential consequences are too high, an alternative to resolving your case by trial is to accept a plea agreement. It is important to have a criminal lawyer, whether hired or court appointed, helping you with your case, but this is especially true if you are considering a plea.
There are many reasons to be kind to your paralegal, but a bonus is that the jury will notice. Be nice to the stenographer (who also has the power to make things go your way, or not, in the transcript). And, especially, have a positive relationship with the courtroom clerk. The clerk checks in the jurors every morning, brings them pencils and leads them to the jury room. This person inevitably forms a stronger bond with them than anyone else in the courthouse. If the jurors see that you’re the clerk’s friend, you’re the jurors’ friend by association. If the clerk hates you, the jurors probably will, too.”

Whether you have been sued, or are planning to sue, you can win your case at various stages of the litigation. You must understand the law as well as the applicable procedural rules. There was a study conducted in the Supreme Court Economic Review that shows why litigation financing can be practical and beneficial to the overall court system and lawsuits within the court. This study concluded that the new rules that were set for litigation financing actually did produce more settlements. Under conservative rules, there tended to be fewer settlements, however under the older rules they tended to be larger on average.[11]

It is now official: Conservative Judge Brian Hagedorn has defeated liberal Judge Lisa Neubauer (pictured) in Wisconsin’s Supreme Court election. Neubauer conceded on Wednesday in a very close race, where Hagedorn won by 6,000 votes despite being the underdog. This result is a significant reversal from 2018 when the conservative Judge Michael Screnock lost by 12% to the liberal (now Justice) Rebecca Dallet. More importantly, this election was a flip from blue to red. The state Supreme Court result not only has significant consequences for policy in Wisconsin, but it is an important signifier heading into 2020.
Unless you are going to Small Claims Court without an attorney, if you are taking this case to court to save money or get a big payoff, it won't happen. A good example is taking a non-compete agreement case to court. After many months, perhaps years, of litigation on whether the non-compete is reasonable and whether the other party breached your non-compete agreement, the only people who win are the attorneys.

Support legal teams with “friend-of-the-court” briefs: Amicus briefs (“friend-of-the-court” briefs) can be filed by groups that seek to expand on legal teams’ arguments or bring an additional perspective to the conversation. During marriage legal cases, state and national partners often came together to line up robust amici briefs, and as marriage work shifted overwhelmingly to the courts in 2014, a significant amount of work involved enlisting signers. Hand-in-hand with our legal advocacy organizations Freedom to Marry worked to enlist signers who could demonstrate most powerfully that America was ready for marriage nationwide.  This included Republican officials, faith leaders, businesses, first responders, and mayors. During these court cases, we generated media and public discussion by highlighting the numbers and prominence of signers on amicus briefs, and putting forward their business/public health/faith, etc., case for ending marriage discrimination.

I’m not sure we did capture all the possible cases. The highly publicized cases, like DACA and the travel ban, are obvious. Nobody seems to keep some sort of master list of everything else. San Antonio, TX On March 8, 2019, Joe William Contreras, along with 17 other service members filed a 3M Combat Arms defective earplug lawsuit in the U.S. District Court for the Western District of Texas. According to the Complaint, Contreras and the other plaintiffs suffer from hearing loss because 3M Company and its predecessor sold millions of dollars’ worth of Combat Arms earplugs to the military without disclosing design flaws that rendered the product useless.

The Las Vegas Municipal Court offers the Habitual Offender Prevention & Education (HOPE) Court. It is an alternative approach to sentencing that offers repeat offenders structured programs to try to help them rebuild their lives. The court has been featured in the local media because of its success. The target goal of HOPE Court is to decrease instances of criminal activity committed by an increasing large group of offenders who repeatedly consume large dollar amounts of city resources because they repeatedly end up back on the streets—loitering; being picked up again and again by police officers; back in city jail; back in court; and back in front of the judge. HOPE Court clients are indigent; they are not able to self-pay.
The WIN Court program is dedicated to the treatment and recovery of each participant; assisting with developing a transition plan to set them on a journey of a new life and provide the foundation for a successful future filled with possibilities. WIN Court focuses on teaching balance, resilience and empowerment. They complete an intensive supervised program where they work hard to embrace healthy and productive lifestyles through education, substance abuse treatment, mental health and/or individual therapy, vocational training, financial and life skills.   The women do the tough introspective work and commit themselves to their recovery. They learn parenting and communication skills in order to reunite with their children and estranged families.
