Kill them with kindness. “Be nice to everyone in the courtroom. Kindness makes the world a better place, and it makes you a happier person. But if that’s not enough to convince you, consider this: Kindness makes you more likely to win your case. When jurors think you’re a good person, they’ll give you the benefit of the doubt and ascribe good motives to what you say. If they think you’re nasty or dishonest, they’ll discount everything that comes out of your mouth.

Industry, CA: Simon Chu and Charley Loh, part-owners and former executives of Chinese appliance manufacturer Gree Electric Appliances and a company that imported, distributed, and sold China-manufactured dehumidifiers to retailers, allegedly knew the dehumidifiers caught fire but failed to report and recall (too expensive) the defects for at least six months. According to the indictment, the two men “deliberately” withheld information about the defective dehumidifiers.

Pretty good book but in the real world it may not help you much. I decided to fight a ticket and the cop lied on the stand and I wasn't really prepared for that and the jurors were all dumb as a box of rocks and I could only choose 5 out of 30 to reject in Voir Dire. So the book has good ideas but the U.S. legal system is so jacked up that if you are a little guy you are going to have to bend over one way or another. Can't wait for the revolution, this system has to go.
Study the statute of limitations for your state. Each claim brought by a plaintiff must be brought within a certain amount of time. For example, a breach of contract claim in New York must be brought within six years from the date of the breach. A lawsuit for defamation brought in Utah must be brought within one year. A prosecutor in Colorado must charge you with misdemeanor theft within 18 months of your alleged shoplifting.

Another key aspect was that Judge Neubauer tried to position herself as a moderate and independent judge, despite being very connected to the Democratic Party and Planned Parenthood. When voters were informed of her connections to socialist policies and infanticide-supporting groups, it helped Hagedorn. Our organization, American Majority Action, saw this as we went door to door and spoke to voters in real time. We focused on voters in seven counties across the state. Our survey results showed a 10+% shift to Hagedorn over the final two weeks as more voters were informed of Neubauer’s radical ties. In places where we knocked on doors, we saw votes shift by 15% or more from their 2018 totals. In Oostburg, where we spoke with hundreds of voters, we saw Hagedorn receive 361 more votes than Screnock in 2018. This happened in communities all across the state. Face-to-face communication is the best way to win over voters in any election, and given the unfair attacks by liberals in this case, it proved particularly effective.

Prepare to defend court victories politically: Winning in court often isn’t enough, as opponents can mount attempts through legislatures or at the ballot to reverse good decisions and otherwise try to delegitimize the win. State constitutional amendments nullified court victories in Hawaii in the 1990s and stripped away the freedom to marry in California in 2008. Advocates should be completely prepared to fight back against efforts to overturn the rulings, and should also work post-victory to allay concerns, refute falsehoods, and solidify support so as to leverage the win. In Massachusetts, for example, the Massachusetts Supreme Judicial Court victory on the freedom to marry was immediately followed by attempts in the legislature to pass a constitutional amendment repealing the freedom to marry. Without the strong leadership of MassEquality, supported by national groups and funders, and many months of public education work and organizing across the state, the nation’s first marriage state could have been a short-lived triumph. Similarly, in New Mexico in 2013, we prepared for an eventual state Supreme Court ruling on marriage by launching one of our joint campaigns, New Mexico United for Marriage, focused singularly on protecting the ruling, organizing in the legislature, and directing state-wide attention to the joy brought on by the freedom to marry.
It does seem crazy, but when you read the cases and the opinions of the judges, including Republican judges, that’s what they found in so many instances. It’s hard to tell whether the agencies knew that they were out on a limb with so many of these decisions and went ahead anyway, or didn’t have competent legal advice. Some experts, as the article said, thought that the failure of some agencies to “do their homework” as they suspended or delayed regulations, for example, showed that they were more interested in making announcements of deregulatory change than in the change itself, so the risk of a judge blocking their actions didn’t concern them all that much. Of course, the agency spokespeople deny that. But lawyers know, for example, that the law sometimes requires public notice and comment when making regulatory change. It’s not hard. It just slows things down. But if they fail to do it, it’s almost a certainty that a judge will object. These are not close calls. Now some of the cases, like the census case (the Commerce Department’s decision to add a citizenship question to the census), are much more complex than what I’m describing and raise deeper issues, which we continue to pursue.
The official ruling of a lawsuit can be somewhat misleading because post-ruling outcomes are often not listed on the internet. For example, in the case of William J. Ralph Jr. v. Lind-Waldock & Company (September 1999), one would assume that Mr. Ralph lost the case when in fact, upon review of the evidence, it as found that Mr. Ralph was correct in his assertion that improper activity took place on the part of Lind-Waldock, and Mr. Ralph settled with Lind-Waldock.
